Universal Declaration on Bioethics and Human Rights

Published November 26, 2021 by tindertender

The General Conference,

Conscious of the unique capacity of human beings to reflect upon their own existence and on their environment, to perceive injustice, to avoid danger, to assume responsibility, to seek cooperation and to exhibit the moral sense that gives expression to ethical principles,

Reflecting on the rapid developments in science and technology, which increasingly affect our understanding of life and life itself, resulting in a strong demand for a global response to the ethical implications of such developments,

Recognizing that ethical issues raised by the rapid advances in science and their technological applications should be examined with due respect to the dignity of the human person and universal respect for, and observance of, human rights and fundamental freedoms,

Resolving that it is necessary and timely for the international community to state universal principles that will provide a foundation for humanity’s response to the ever-increasing dilemmas and controversies that science and technology present for humankind and for the environment,

Recalling the Universal Declaration of Human Rights of 10 December 1948, the Universal Declaration on the Human Genome and Human Rights adopted by the General Conference of UNESCO on 11 November 1997 and the International Declaration on Human Genetic Data adopted by the General Conference of UNESCO on 16 October 2003,

Noting the United Nations International Covenant on Economic, Social and Cultural Rights and the International Covenant on Civil and Political Rights of 16 December 1966, the United Nations International Convention on the Elimination of All Forms of Racial Discrimination of 21 December 1965, the United Nations Convention on the Elimination of All Forms of Discrimination against Women of 18 December 1979, the United Nations Convention on the Rights of the Child of 20 November 1989, the United Nations Convention on Biological Diversity of 5 June 1992, the Standard Rules on the Equalization of Opportunities for Persons with Disabilities adopted by the General Assembly of the United Nations in 1993, the UNESCO Recommendation on the Status of Scientific Researchers of 20 November 1974, the UNESCO Declaration on Race and Racial Prejudice of 27 November 1978, the UNESCO Declaration on the Responsibilities of the Present Generations Towards Future Generations of 12 November 1997, the UNESCO Universal Declaration on Cultural Diversity of 2 November 2001, the ILO Convention 169 concerning Indigenous and Tribal Peoples in Independent Countries of 27 June 1989, the International Treaty on Plant Genetic Resources for Food and Agriculture which was adopted by the FAO Conference on 3 November 2001 and entered into force on 29 June 2004, the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) annexed to the Marrakech Agreement establishing the World Trade Organization, which entered into force on 1 January 1995, the Doha Declaration on the TRIPS Agreement and Public Health of 14 November 2001 and other relevant international instruments adopted by the United Nations and the specialized agencies of the United Nations system, in particular the Food and Agriculture Organization of the United Nations (FAO) and the World Health Organization (WHO),

Also noting international and regional instruments in the field of bioethics, including the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine of the Council of Europe, which was adopted in 1997 and entered into force in 1999, together with its Additional Protocols, as well as national legislation and regulations in the field of bioethics and the international and regional codes of conduct and guidelines and other texts in the field of bioethics, such as the Declaration of Helsinki of the World Medical Association on Ethical Principles for Medical Research Involving Human Subjects, adopted in 1964 and amended in 1975, 1983, 1989, 1996 and 2000 and the International Ethical Guidelines for Biomedical Research Involving Human Subjects of the Council for International Organizations of Medical Sciences, adopted in 1982 and amended in 1993 and 2002,

Recognizing that this Declaration is to be understood in a manner consistent with domestic and international law in conformity with human rights law,

Recalling the Constitution of UNESCO adopted on 16 November 1945,

Considering UNESCO’s role in identifying universal principles based on shared ethical values to guide scientific and technological development and social transformation in order to identify emerging challenges in science and technology taking into account the responsibility of the present generations towards future generations, and that questions of bioethics, which necessarily have an international dimension, should be treated as a whole, drawing on the principles already stated in the Universal Declaration on the Human Genome and Human Rights and the International Declaration on Human Genetic Data and taking account not only of the current scientific context but also of future developments,

Aware that human beings are an integral part of the biosphere, with an important role in protecting one another and other forms of life, in particular animals,

Recognizing that, based on the freedom of science and research, scientific and technological developments have been, and can be, of great benefit to humankind in increasing, inter alia, life expectancy and improving the quality of life, and emphasizing that such developments should always seek to promote the welfare of individuals, families, groups or communities and humankind as a whole in the recognition of the dignity of the human person and universal respect for, and observance of, human rights and fundamental freedoms,

Recognizing that health does not depend solely on scientific and technological research developments but also on psychosocial and cultural factors,

Also recognizing that decisions regarding ethical issues in medicine, life sciences and associated technologies may have an impact on individuals, families, groups or communities and humankind as a whole,

Bearing in mind that cultural diversity, as a source of exchange, innovation and creativity, is necessary to humankind and, in this sense, is the common heritage of humanity, but emphasizing that it may not be invoked at the expense of human rights and fundamental freedoms,

Also bearing in mind that a person’s identity includes biological, psychological, social, cultural and spiritual dimensions,

Recognizing that unethical scientific and technological conduct has had a particular impact on indigenous and local communities,

Convinced that moral sensitivity and ethical reflection should be an integral part of the process of scientific and technological developments and that bioethics should play a predominant role in the choices that need to be made concerning issues arising from such developments,

Considering the desirability of developing new approaches to social responsibility to ensure that progress in science and technology contributes to justice, equity and to the interest of humanity,

Recognizing that an important way to evaluate social realities and achieve equity is to pay attention to the position of women,

Stressing the need to reinforce international cooperation in the field of bioethics, taking into account, in particular, the special needs of developing countries, indigenous communities and vulnerable populations,

Considering that all human beings, without distinction, should benefit from the same high ethical standards in medicine and life science research,

Proclaims the principles that follow and adopts the present Declaration.

Article 6 – Consent

1. Any preventive, diagnostic and therapeutic medical intervention is only to be carried out with the prior, free and informed consent of the person concerned, based on adequate information. The consent should, where appropriate, be express and may be withdrawn by the person concerned at any time and for any reason without disadvantage or prejudice.

2. Scientific research should only be carried out with the prior, free, express and informed consent of the person concerned. The information should be adequate, provided in a comprehensible form and should include modalities for withdrawal of consent. Consent may be withdrawn by the person concerned at any time and for any reason without any disadvantage or prejudice. Exceptions to this principle should be made only in accordance with ethical and legal standards adopted by States, consistent with the principles and provisions set out in this Declaration, in particular in Article 27, and international human rights law.

3. In appropriate cases of research carried out on a group of persons or a community, additional agreement of the legal representatives of the group or community concerned may be sought. In no case should a collective community agreement or the consent of a community leader or other authority substitute for an individual’s informed consent.

Article 7 – Persons without the capacity to consent

In accordance with domestic law, special protection is to be given to persons who do not have the capacity to consent:

(a) authorization for research and medical practice should be obtained in accordance with the best interest of the person concerned and in accordance with domestic law. However, the person concerned should be involved to the greatest extent possible in the decision-making process of consent, as well as that of withdrawing consent;

(b) research should only be carried out for his or her direct health benefit, subject to the authorization and the protective conditions prescribed by law, and if there is no research alternative of comparable effectiveness with research participants able to consent. Research which does not have potential direct health benefit should only be undertaken by way of exception, with the utmost restraint, exposing the person only to a minimal risk and minimal burden and, if the research is expected to contribute to the health benefit of other persons in the same category, subject to the conditions prescribed by law and compatible with the protection of the individual’s human rights. Refusal of such persons to take part in research should be respected.

Article 8 – Respect for human vulnerability and personal integrity

In applying and advancing scientific knowledge, medical practice and associated technologies, human vulnerability should be taken into account. Individuals and groups of special vulnerability should be protected and the personal integrity of such individuals respected.

Article 9 – Privacy and confidentiality

Article 10 – Equality, justice and equity

The fundamental equality of all human beings in dignity and rights is to be respected so that they are treated justly and equitably.

Article 11 – Non-discrimination and non-stigmatization

No individual or group should be discriminated against or stigmatized on any grounds, in violation of human dignity, human rights and fundamental freedoms.

Article 12 – Respect for cultural diversity and pluralism

The importance of cultural diversity and pluralism should be given due regard. However, such considerations are not to be invoked to infringe upon human dignity, human rights and fundamental freedoms, nor upon the principles set out in this Declaration, nor to limit their scope.

Article 13 – Solidarity and cooperation

Solidarity among human beings and international cooperation towards that end are to be encouraged.

Article 14 – Social responsibility and health

1. The promotion of health and social development for their people is a central purpose of governments that all sectors of society share.

2. Taking into account that the enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition, progress in science and technology should advance:

(a) access to quality health care and essential medicines, especially for the health of women and children, because health is essential to life itself and must be considered to be a social and human good;

(b) access to adequate nutrition and water;

(c) improvement of living conditions and the environment;

The Ten Principles of the Nuremberg Code

Published November 26, 2021 by tindertender

On August 19, 1947, the judges of the American military tribunal, before rendering verdict in the Doctors’ Trial USA vs. Karl Brandt et al., presented ten basic principles for human experimentation ‘in order to satisfy moral, ethical and legal concepts’ under a section entitled Permissible Medical Experiments.  They became known as the Nuremberg Code.

1. The voluntary consent of the human subject is absolutely essential. This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision. This latter element requires that before the acceptance of an affirmative decision by the experimental subject there should be made known to him the nature, duration, and purpose of the experiment; the method and means by which it is to be conducted; all inconveniences and hazards reasonable to be expected; and the effects upon his health or person which may possibly come from his participation in the experiment. The duty and responsibility for ascertaining the quality of the consent rests upon each individual who initiates, directs or engages in the experiment. It is a personal duty and responsibility which may not be delegated to another with impunity.

2. The experiment should be such as to yield fruitful results for the good of society, unprocurable by other methods or means of study, and not random and unnecessary in nature.

3. The experiment should be so designed and based on the results of animal experimentation and a knowledge of the natural history of the disease or other problem under study that the anticipated results will justify the performance of the experiment.

4. The experiment should be so conducted as to avoid all unnecessary physical and mental suffering and injury.

5. No experiment should be conducted where there is an a priori reason to believe that death or disabling injury will occur; except, perhaps, in those experiments where the experimental physicians also serve as subjects.

6. The degree of risk to be taken should never exceed that determined by the humanitarian importance of the problem to be solved by the experiment.

7. Proper preparations should be made and adequate facilities provided to protect the experimental subject against even remote possibilities of injury, disability, or death.

8. The experiment should be conducted only by scientifically qualified persons. The highest degree of skill and care should be required through all stages of the experiment of those who conduct or engage in the experiment.

9. During the course of the experiment the human subject should be at liberty to bring the experiment to an end if he has reached the physical or mental state where continuation of the experiment seems to him to be impossible.

10. During the course of the experiment the scientist in charge must be prepared to terminate the experiment at any stage, if he has probable cause to believe, in the exercise of the good faith, superior skill and careful judgment required of him that a continuation of the experiment is likely to result in injury, disability, or death to the experimental subject.

Neuroplasticity happens when connections are made across the neural network in our brain. Essentially, our brain creates super-highways that it travels quickly in response to outside stimuli. Thought patterns that are repeated often create massive highways that the thought travels on. The more the thought occurs, the more it will occur.

One of the most effective ways to reprogram the mind, to reformat the consciousness, is through using affirmative statements. I share with you examples that you may find helpful should you wish to use them to assist in reformatting the thinking mind.

Big Bold Vision

Published November 26, 2021 by tindertender

You were not born to play a small role in life. You have the ability to dream big. Even if you have absolutely no idea about how your visions can come to pass or what all the details may look like, you can access the heart and guts of a vision by tapping into your wildest dreams and surrendering attachment to exactly how it will all work out. The details are up to the creative genius of the universe. You are an active, contributing participant but not the sole player in your life journey.

There is something – a vision or an idea – that is coming to you. You may worry that it is too much for you. But, don’t worry. It is meant to be yours. Although you might have some adjustments to make and some tweaking to do as you let go of your limited thinking and open up to a fearless acceptance of bigger, brighter, more radical and more potent possibilities of creatively living your light in the world.

A sign that you are cracking out of your limited thinking, to allow for a big, bold vision to come to you, is that you might feel a little dizzy with the shrinking limitations and expanding possibilities of life. You may wonder if you are allowed to access so much wonder! Remember that your healing and growing success as you manifest this big vision, you can touch the hearts of others through your presence, your inner work, your art and your choices. It is a win-win situation! Those that are meant to live big, bold and visionary lives need to give themselves permission to break the mold and forge newer, more expansive perspectives of what is possible, what is permitted and what is of service. It’s about letting go and opening up. Others will benefit from this. Even though it is your vision, it is not just about you!

Remember that when something is right for you, endless synchronicities and support will flow your way, at the right time and in the right way. Stay open, receptive, playful and surrendered.

You are about to receive or be invited to become part of, a grand visionary beginning. It has the makings of something fantastic. No matter how the journey that brings this vision into reality unfolds – and there will be some twists and turns that you don’t see coming – it is still helpful for you to be open to it. Trust your heart, be still with your choices and when the time feels right and truthful, leap!

If you are looking to further develop your intuitive insight, know that it is already happening. Trust in what you perceive. Even if it conflicts with what everyone else around you is saying or the surface of things, trust your inner perceptions. They are accurate and will be proven to be so later on.

Trust that things will be coming up roses for you. Even if everything seems to be in a bit of a shambles now, it’s really just the essential mess before a truly spectacular success.

Healing process ::
Say, “I release all blocks to my vision. I release all beliefs – conscious or unconscious – stored in my body or mind that would have me belittle or minimize myself out of fear or ignorance. I choose to be bold, big and bright, to vision with my heart and receive all the genius of the universe in supporting that vision in coming to life. So be it.”

Receiving

Published November 25, 2021 by tindertender

You are so loved. Your every need is witnessed and responded to by the universe. However, you sometimes forget this. You become swept up in the momentum of habitual consciousness, and you forget to take a moment to stop, breathe and be. In that moment you can receive the love of the universe that is receiving you. It will nourish you with contentment and energy.

You have not done this enough, so your soul is becoming parched and is drying out. Energy has been going out of you but there is not enough coming back in. It is time to bring something back in for you. To receive and be received. You are being offered a chance for restoration now, to feel nourished, cared for and loved. Accept it! You deserve it.

The healing process below will help you surrender any guilt or shame you feel for having needs in the first place. It will also help you overcome any struggle that you have receiving and accepting, so that your needs can be met.

Do you know how much joy the universe gains from being able to give to you? When you delight in what you receive, when you openly embrace a gift and are happy with it, the universe if fully received by you. In this space there is joyful communion between you and life, energy flows more freely and magic happens. When you demur saying you cannot accept, that it is too great a gift or that you are not worthy, you are impeding that flow. You are inhibiting the communion, the connection, the playful interaction between you and the universe. Enough with the false modesty and guilt! You are a radiant sun in human clothing. An exquisite life experience is your birthright. Enjoy it! Soak it up. All of it. Including the restoration of sacred rest.

From that place of nourishment you will more effortlessly create, live and love with greater energy and thriving, pulsing passion. The earth rests each night so it can greet the sun again each morning with the spectacular living art of sunrise. Allow yourself to switch off, step away, close the laptop, switch off the phone, and just be with yourself for a little while. You will return and be more efficient and effective. Rest now, play now and work later. Forget your worries for awhile. Switch off. Do something else. Let it all go and it will all flow.

Healing process ::
Say aloud, “I release all false guilt and shame about having needs and all false beliefs about rest being wasteful or unnecessary. I accept healthy, productive, sacred rest and the gifts of happiness that it brings. I understand that rest and activity, balance, feed and nourish each other. There is sacred healing that happens through rest, which is very powerful. I accept and receive this now. Through unconditional love, this is now so.”

Then read this story aloud, as though you were lovingly reading to yourself as a child. You may like to curl up comfortably on the sofa.

The great French Impressionist painter, Monet, sat in his garden on a warm afternoon. He was napping lightly on his garden bench, with the sunlight dappling gently through the straw hat resting over his face. It was soft and warm on his closed eyelids. He sighs contentedly.

A nosy neighbor poked his head over the fence, keen to know what the brilliant artist was up to now. “Sir, you are resting!” the curious neighbor called out.

“No,” responded Monet, wriggling to get even more comfortable on his reclining garden chair, “I am working.” He relaxed further as the mild breeze tickled the hair on his forearms.

Monet returned to his garden the next day. Consumed by the urge to translate his feelings onto the canvas, he painted with great energy and focus. He was inspired and the paint flowed. Again the nosy neighbor poked his head over the fence. He called out, “Sir, you are working!”

“No,” said the artist, barely pausing with his brush, “I am resting.”

When you are done, give yourself a hug and perhaps have a nap or a cup of tea, or do a little dance around your living room. Or paint, relax, go for a walk in the park or do a spot of window shopping. Just be, play, laugh and relax. Give yourself what you feel you need at this time. If you aren’t certain, that’s fine. Guess! And know that the more often you do this, the more skilled you will become in identifying and meeting your needs.

Joan of Arc. Jules Bastien-Lepage, 1897. Oil on canvas.

I stay centered in my heart.

I stay true to myself.

I let my ideas live. I let them be without judgement.

I honor life on this planet.

I open myself to receive more nurturing.

I value myself.

I practice patience while I await resolution to that which has challenged me.

I refuse to be conquered by fear.

I remain faithful to love.

I am loved by the Universe.

My every need is witnessed and responded to.

I open to receive this love, this kindness.

I accept restoration.

I am worthy of such love and attention.

I seek the mirror that reflects back to me my own greatness and beauty.

I behold myself without judgement and I let fear fall away.

I step back from others responses to me.

I stop taking on the feelings of others.

I let external perceptions go.

I visualize my space filled with great love. I focus on the light within me. This light shines out of me.

I harness the power of the unconscious mind to affect change and healing in my life.

I trust my feelings.

In the World, Not of the World

It is safe for you to become naked with life. This doesn’t necessarily mean stripping off and running wild in public. It does mean stripping back your beliefs, strongholds and mental or emotional security blankets so that you can live with less obstruction than ever before. Imagine the conditioning that has kept life away from you, just kept it dropping out of your hands like keys, coins or clocks. Conditioned beliefs about money, time, security, having, locking away, holding and controlling can be surrendered and allowed to fall away. What would it be like to feel as though you were on holiday every day? Perhaps there would be a softening in your way with life, an implicit trust in its flow and a faith in the ability of time to bend and stretch as needed so that all may be accomplished. It is an advanced stage of our spiritual relationship with life that we are able to feel held within it sufficiently enough to surrender our defenses, layer by layer, and to nakedly accept what is.

Sometimes we need our defenses. At other times, it is clear we are outgrowing them. There is something you have outgrown. It has to do with your ideas about productivity, time, control and money. It has to do with abundance, trust and living with the fundamental belief that everything is going to turn out okay. You are ready to be much more vulnerable and exposed to life. You don’t have to hide behind being organized, perfect, in control or financially secure and stable. Nor do you need any other ‘acceptable’ social face. It is time for you to loosen the strings of your own controlling nature. They are too tight and restrictive for you anyway. You were born to live in a much freer way. When you live as you innately are, rather than how you have been conditioned to be, you will experience greater joy, freedom and support. When you are not resisting yourself or resisting life, there is less resisting what you need as it comes to you.

You are shedding. It might be an identity, it might be a status symbol such as a car, home or suburb and it could even be a socially admired relationship. You are shedding because no matter what the appearance of things, those old forms were too constricting for you. It is almost like your spirit was trying to walk about in shoes several sizes too small – they were starting to pinch, the seams were ripping and eventually they would fall apart completely.

Likewise, you are being stripped of internal beliefs that are failing you, perhaps externally as well. Whether this seems to be your choice or not, make no mistake, it is your own spirit in cahoots with the loving spirit of life that has brought this situation about.

You are being guided to trust. Rely on life, and also on your inner knowing because at some point level, you get it. You understand and know that this is all freeing you. After letting go, there comes a temporary emptiness that provides a greater space for fulfillment to come forth.

Healing process ::
Imagine you are running naked into a sea, ocean, river or waterfall. Be cleansed. Feel it happening. Be with it and enjoy the sensation of it. Feel freed of any weight that you no longer need, be it physical, emotional, mental or spiritual. Let go on all levels.

When you are ready, just open your eyes and rest for a few moments before going back into your day or evening. You have completed your healing process.

Affirmations ~ November 23, 2021

Neuroplasticity happens when connections are made across the neural network in our brain. Essentially, our brain creates super-highways that it travels quickly in response to outside stimuli. Thought patterns that are repeated often create massive highways that the thought travels on. The more the thought occurs, the more it will occur.

One of the most effective ways to reprogram the mind, to reformat the consciousness, is through using affirmative statements. I share with you examples that you may find helpful should you wish to use them to assist in reformatting the thinking mind.

Jacob’s Dream
William Blake, ca. 1805

I give myself permission to be fully myself. I am whole. I live freely.

What flows from me will eventually flow to me.

I send out my love. Love will return to me.

I go against the grain. There is always another way.

I listen to my heart.

I need not fear loss. What is meant to come to me will not be denied. It is safe for me to let go.

What I want wants me.

I trust in what I truly want, not its substitutions.

I hold this in my heart.

I do not give up on my vision.

I keep dreaming of my fulfillment.

I live as though my dream is real, right now.

I allow my truest self freedom of expression.

I open my heart to the sensation of love.

I unhide myself.

I have the ability to navigate through anything life brings to my door.

I trust in the love of my heart.

I am bringing myself to life right now.

I am shaking things up.

I permit my feelings to flow.

I will live a vibrant fresh new life!

I nurture it to fulness.

Release the Dark Wound, Let Love Live

Published November 23, 2021 by tindertender

If we detach something from its source too soon, trying to force it to become what it is not yet ready or willing to become, we can unintentionally sap it of its strength and kill it. There is a dark wound in the consciousness of humanity which demands perfection and denies process. If you are thinking of publishers before you have even written the book, if you are comparing your unfinished song idea to the latest best-selling pop release, if you have decided you are not good enough or worthy enough to succeed before you’ve given it everything you’ve got and asked for divine help, then this dark wound has you in its grasp.

You have to let go of the death-grip of perfectionism and let yourself and your ideas live. Love is abundant, creative and inspiring. It moves us so much more joyously and creatively than fear. Honor the path of your own love – what inspires you, what feels exciting, joyful and perhaps even rather different? Let that live! Release the dark wounding of false belief. There are countless stories of vastly successful artists who very nearly binned the project that was making their career, because of the despair fostered by their own dark nature. They doubted. They were uncertain. Was their work any good? Was it useless? They struggled to believe in the right of a work to come to life, whether it was accepted, revered or rejected by others or not. They nearly lost their work to fear. Undoubtedly there have been many times when this has actually happened, and the work was not saved, not allowed to live. Do not let this happen to you. Whether something is meant to be a commercially-oriented venture or a more personal creation for your own therapeutic healing, it must be allowed to be, without judgement, without criticism, even without premature evaluation. It must be allowed to be what it is, and only time, love, patience and attention will reveal it.

Act on this immediately so that your path can continue under the protection of grace and wisdom.

Healing process ::
Say the declaration below out loud three times. Be in your heart and really feel what you are expressing.
I now choose of my own free will to release all cellular memories and belief systems based in the dark wound of criticism, judgement, shaming and fear, so that my creative, loving energy may thrive in a nourishing environment conducive to growth. Through all time and space, through all dimensions of my being, through unconditional love, so be it.
