I face this new cycle with courage.

There is a healing force entering my life.

I am aware.

I accept this grand vision that has rested upon my mind. It is possible.

Against the Grain

You want birds to be able to fly under water. You want love to trump power. You want humanity to relate to each other as equals and to recognize the sacredness in you and in the world around you. You want to unleash the beauty that hides in even the ugliest of scenes or sentiments. You want to make possible what others say cannot be. You are a radical dreamer, a sacred rebel, and you bring the light of a more positive future to this world.

However, this can have its burdens. Deep within you may feel that you don’t really fit in with the rest of the world. Perhaps your sense of how things can be and how they really are, is so different to the smaller minds or more fearful hearts of many others that you are rarely received for all that you offer. This might make you feel frustrated, thwarted or lonely at times.

The universe so loves you for your unusual take on things, for the quirkiness in you that dares to honor that which is different and renders the impossible, possible. You must never, ever lose your unusual ways and become dry, serious, appropriate and conventional – not even for appearance’s sake – for you would lose your essence. You are here to show what life is about so much more than conventional success.

You are someone who lives and breathes in the depths of creative waters. You need to lose yourself to the flow of music, nature, dreams, imagination and fantasy, through art and literature, meditation, dance and in sensual surrender to the sacred waters of the ocean, the river, the lake – or the bathtub!

You must go against the grain. It is just your way. You are not one of the followers but one of the agitators. However, yours is not a force of disrespectful chaos. You are a loving catalyst and by simply being yourself, you constantly remind people that there is always another way. You are meant to be exactly who you are. You are meant to be the black sheep, the rainbow sheep or even the wild wolf in the flock of sheep! The daring butterfly spirit calling to the caterpillars – that is you. The price you pay for the gift of individuality is that you must take care of it and guard it so that you are not dulled down and conditioned into playing at being something you are not.

If this has happened, or ids threatening to happen, this oracle brings you comfort. You will always dream of birds that can fly underwater. You know that the true nature of your being can never be changed – at most, it could only be hidden for a time. Now is the time to accept who you are and allow your truths to be fully expressed. Don’t worry about the effects of going against the grain. When we are who we are in truth, we attract the support, protection and energy that we need to thrive. Your power comes from aligning your outward self with your inner truth, not with the general consensus. You will then find other dreamers, other wild butterflies and atypically colored sheep to join you in conjuring better visions for our world.

Healing process ::
Close your eyes and relax. Take seven deep breaths in and out as you bring your awareness into your body and the space that exists within your body.

When you are relaxed, imagine, sense or perceive a winding river of golden light that starts below your feet. Sense it gathering there as a pool of liquid golden energy. It has an intelligence of its own and it winds its way into beautiful patterns before you, flowing with grace and playfulness. This river of light symbolizes your life journey. Just notice it and enjoy it.

See that your life journey is unique. You may focus on your own river of life or expand your awareness to sense the rivers of light that represent the journeys of those around you. You may see, sense or feel that their paths are unique to them also. No-one has the exact same journey to take, even though we are all heading towards the one destination of absolute love.

Say the following aloud, “I honor myself. I honor the truth that I express through my very being. I accept the protection that I am offered so that I may go against the grain from a place of love and as an invitation for others to be open to life. So be it.”

When you are ready, simply open your eyes and sit quietly with your hand on your heart for a moment. You have completed your healing process.

Just as we receive gifts in the physical world, through the thoughtfulness of others, to acknowledge how much we mean to them, so too we receive gifts on other levels – including the spiritual level.

A spiritual gift is something that happens through grace. We can ask for help and it may be given in response to that request. All requests for help are answered. A spiritual gift can also be given without us asking for anything at all – at least not consciously. Sometimes it is our hearts that cry out for help. While we are busy getting on with our to-do-lists, we don’t often stop to think about what our hearts might need. If we do, and an immediate solution is not obvious, we just get on with life either letting the issue be or taking the more painful option of dwelling on it without seeing how it might be resolved.

However, there is a loving benevolence in life that knows exactly what we need and how it can best come to us, even when we are not quite so clear. This force actively seeks to assist us in walking our life path. That loving sweetness is being offered to you now, or soon will be, in the form of a spiritual gift.

Your spiritual gift may be symbolic. It may be something that seems ordinary but holds a lot of meaning to you. You might think you are appreciating how lovely it looks, but it is the underlying energy that captures you. Something in the appearance, color or shape speaks to you and is, perhaps, answering an unspoken prayer. It is not the object that is the gift. That is just the wrapping. The actual gift is subtle, yet effective empowerment. It is like a spiritual booster shot that helps you move foreword in life with additional zing, extra strength and greater peace.

You will be empowered to accomplish tasks that you may have nearly, but not quite, been able to manage on your own through the bestowal of a spiritual gift.

The spiritual gift may or may not be recognizable to you. It may be very obvious – an offer, a windfall, a trip, a friendship, a new lover or a remarkable healing in a current relationship. It might be far more subtle and even more powerful such as a jolt of energy that allows you to perceive things differently all of a sudden and perhaps solve a problem that has been plaguing you. It will be bestowed as and when it is needed, in the form that will best serve the love in you.

Let yourself be helped. Assistance is coming your way so act on it and say yes. It is very significant as the assistance is coming from the hand of life itself. Trust it.

Trust in the things that you feel and say to others without knowing why. It moves them. You might not understand, but through trust you are allowing yourself not to over-think and censor yourself. As such you are able to become a vessel through which the spiritual gift can be passed onto others. Don’t block yourself. Let life happen through you. Only benefit can come from this.

Look, love is speaking to you directly here – so pay attention. Really feel the truth of what is being said and trust it! You are being helped!

It is simple to receive the gift that is headed your way. The healing process below will activate that for you.

Spicy Turkey Soup

Intending to change preconditioned, habitual patterning surrounding food, I have whittled down the amount of meat in my diet over the last several years. I feel very good about this change.

My father joined me for dinner this Thanksgiving holiday. He told me that he did not want me cooking meat, as he knows I try to avoid it. What is a daughter to do? My father came for supper, and he eats meat on a regular basis.

I was not going to make him eat vegetarian, so I bought, and roasted him a turkey breast … and I used the leftover to make soup for the pantry. I was not going to waste one portion of it, out of respect for the life it once was. And yes, I will eat it, out of respect for the life it once was, because I made the purchase. And I will be grateful for the nourishment every time I do.

I doubled the recipe and then some, with the exception of the meat. After having it for supper, I managed to create 15 pints and 3 quarts of delicious soup for the pantry.

Recipe

1/2 tablespoon oil
1 green pepper, diced
1 onion, diced
4 cups turkey stock
2 cups leftover turkey
1 cup frozen corn
2 (16 oz cans) black beans, drained
2 (15 oz cans) diced tomatoes with green chiles
2 tablespoons taco seasoning
4 ounces cream cheese (If dairy free or canning, leave out this ingredient. The cheese can be added at the time of cooking at a later date for creaminess if desired).

Sauté the onion and green bell pepper. Add it to slow cooker with all other ingredients (except cream cheese, this goes in before serving). Cook on low for 8 hours.

Pressure canning:
Bring to 11 lbs pressure and keep it there for 75 minutes pints, and 90 minutes quarts.

Visions of Life Beyond Death

Sacred vision is awakening within you. You are becoming blessed with the ability to truly see. To what is real rather than what appears to be. This is true insight.

What was once considered consequential may soon be found to hold little consequence after all. What was once dismissed as an irritation or irrelevance may be seen to have great spiritual significance. As mundane as something once appeared it could now be worthy of absolute attention. The gift of genuine vision takes you into the being of the universal creator. This is sacred terrain, beyond logic, convention and that which is limited in any way. The more open you are to receiving true vision, the more love you will feel and recognize within and around you. Something may appear to change form, to be shed, to be lost or to die but there is love within it always. This realization doesn’t remove the pain of the loss. It does provide a way through which it can be healed and eventually transformed into peace.

The vision of love, the truth of all that is, can move us more than anything else possibly can. If you have been wondering about your path or whether you should take action on a project or you need inspiration to really move you out of a slump you have fallen into, have hope. You will receive your vision. You will be graced with a way out of the stagnancy. You will be able to see things differently and more accurately. Any confusion or uncertainty you have felt is going to pass and you will be left with clear insight. The stories you have been feeling, feeding yourself or telling yourself may end up looking different to how they appear now. This may surprise you, but the vision that is coming to you will be more truthful and therefore freeing. It will be worth the shock, surprise or the moment of embarrassment when you realize you have been operating under a false assurance or deluding yourself about the truth of a situation. Those moments will pass and they are not something to feel bad about. They signify that you are leaving behind a smaller view for a more expansive one. They are a sign that you have outgrown your old vision in order to live in a bigger one. This is good! There might be a moment when your ego feels a bit dented, but sure enough that too will pass.

You are watched over by life and held in protection. Whatever has been bothering you will not be able to harm you. You will prevail. If you are concerned that someone is getting away with something or blocking your path and it seems there is nothing you can do about it, don’t worry. The All-Seeing Eye of Life perceives everything, without exception. It is the universal mother with eyes not only in the back of her head but in every living cell of life itself. She misses nothing! And the truth of her vision will always be met with justice, mercy and wisdom.

Shift your perspective and look at an issue of concern a little differently. If you don’t know how to do this, simply add the following statement to the end of the healing process below, “I call upon the Universal Eye to show me the most helpful way to see this situation of concern now.” In shifting how you look at things, the energy in what is beheld changes. You can see this with people. When you shame and judge someone they react differently to when they are loved and encouraged. They may succeed nonetheless, but the journey to that success will be different. Looking at something through the eyes of love rather than fear, can help us find our way more quickly, easily and enjoyably.

Your ability to perceive is expanding into truth. Your ability to be inspired and see the light in all things is unfolding. It must be nourished in your heart with loving acceptance because you are going to help others through your vision, your art and how you choose to be in the world. The healing process below will help you accept and anchor this developing gift.

Healing process ::
Say aloud, “I now release any fear I have associated with seeing truth, with seeing beyond the veil of illusion or with my inner vision opening up, from my heart, mind and body. I release any wounding I have received in relation to what I have witnessed at any time especially where it is based in the fearful responses of others. I ask that my vision be restored to its fulness, through compassion and unconditional love. So be it.”

Close your eyes. Imagine love pouring down from the universe straight into your head, reaching behind your eyes and feeling really good.

When you have had enough of this, simply open your eyes and imagine you can breathe or exhale any excess energy gently out through them.

Then you have finished your healing process.

Universal Declaration on Bioethics and Human Rights

The General Conference,

Conscious of the unique capacity of human beings to reflect upon their own existence and on their environment, to perceive injustice, to avoid danger, to assume responsibility, to seek cooperation and to exhibit the moral sense that gives expression to ethical principles,

Reflecting on the rapid developments in science and technology, which increasingly affect our understanding of life and life itself, resulting in a strong demand for a global response to the ethical implications of such developments,

Recognizing that ethical issues raised by the rapid advances in science and their technological applications should be examined with due respect to the dignity of the human person and universal respect for, and observance of, human rights and fundamental freedoms,

Resolving that it is necessary and timely for the international community to state universal principles that will provide a foundation for humanity’s response to the ever-increasing dilemmas and controversies that science and technology present for humankind and for the environment,

Recalling the Universal Declaration of Human Rights of 10 December 1948, the Universal Declaration on the Human Genome and Human Rights adopted by the General Conference of UNESCO on 11 November 1997 and the International Declaration on Human Genetic Data adopted by the General Conference of UNESCO on 16 October 2003,

Also noting international and regional instruments in the field of bioethics, including the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine of the Council of Europe, which was adopted in 1997 and entered into force in 1999, together with its Additional Protocols, as well as national legislation and regulations in the field of bioethics and the international and regional codes of conduct and guidelines and other texts in the field of bioethics, such as the Declaration of Helsinki of the World Medical Association on Ethical Principles for Medical Research Involving Human Subjects, adopted in 1964 and amended in 1975, 1983, 1989, 1996 and 2000 and the International Ethical Guidelines for Biomedical Research Involving Human Subjects of the Council for International Organizations of Medical Sciences, adopted in 1982 and amended in 1993 and 2002,

Recognizing that this Declaration is to be understood in a manner consistent with domestic and international law in conformity with human rights law,

Recalling the Constitution of UNESCO adopted on 16 November 1945,

Considering UNESCO’s role in identifying universal principles based on shared ethical values to guide scientific and technological development and social transformation in order to identify emerging challenges in science and technology taking into account the responsibility of the present generations towards future generations, and that questions of bioethics, which necessarily have an international dimension, should be treated as a whole, drawing on the principles already stated in the Universal Declaration on the Human Genome and Human Rights and the International Declaration on Human Genetic Data and taking account not only of the current scientific context but also of future developments,

Aware that human beings are an integral part of the biosphere, with an important role in protecting one another and other forms of life, in particular animals,

Recognizing that, based on the freedom of science and research, scientific and technological developments have been, and can be, of great benefit to humankind in increasing, inter alia, life expectancy and improving the quality of life, and emphasizing that such developments should always seek to promote the welfare of individuals, families, groups or communities and humankind as a whole in the recognition of the dignity of the human person and universal respect for, and observance of, human rights and fundamental freedoms,

Recognizing that health does not depend solely on scientific and technological research developments but also on psychosocial and cultural factors,

Also recognizing that decisions regarding ethical issues in medicine, life sciences and associated technologies may have an impact on individuals, families, groups or communities and humankind as a whole,

Bearing in mind that cultural diversity, as a source of exchange, innovation and creativity, is necessary to humankind and, in this sense, is the common heritage of humanity, but emphasizing that it may not be invoked at the expense of human rights and fundamental freedoms,

Also bearing in mind that a person’s identity includes biological, psychological, social, cultural and spiritual dimensions,

Recognizing that unethical scientific and technological conduct has had a particular impact on indigenous and local communities,

Convinced that moral sensitivity and ethical reflection should be an integral part of the process of scientific and technological developments and that bioethics should play a predominant role in the choices that need to be made concerning issues arising from such developments,

Considering the desirability of developing new approaches to social responsibility to ensure that progress in science and technology contributes to justice, equity and to the interest of humanity,

Recognizing that an important way to evaluate social realities and achieve equity is to pay attention to the position of women,

Stressing the need to reinforce international cooperation in the field of bioethics, taking into account, in particular, the special needs of developing countries, indigenous communities and vulnerable populations,

Considering that all human beings, without distinction, should benefit from the same high ethical standards in medicine and life science research,

Proclaims the principles that follow and adopts the present Declaration.

General provisions

Article 1 – Scope

1. This Declaration addresses ethical issues related to medicine, life sciences and associated technologies as applied to human beings, taking into account their social, legal and environmental dimensions.

2. This Declaration is addressed to States. As appropriate and relevant, it also provides guidance to decisions or practices of individuals, groups, communities, institutions and corporations, public and private.

Article 2 – Aims

The aims of this Declaration are:

(a) to provide a universal framework of principles and procedures to guide States in the formulation of their legislation, policies or other instruments in the field of bioethics;

(b) to guide the actions of individuals, groups, communities, institutions and corporations, public and private;

(c) to promote respect for human dignity and protect human rights, by ensuring respect for the life of human beings, and fundamental freedoms, consistent with international human rights law;

(d) to recognize the importance of freedom of scientific research and the benefits derived from scientific and technological developments, while stressing the need for such research and developments to occur within the framework of ethical principles set out in this Declaration and to respect human dignity, human rights and fundamental freedoms;

(e) to foster multidisciplinary and pluralistic dialogue about bioethical issues between all stakeholders and within society as a whole;

(f) to promote equitable access to medical, scientific and technological developments as well as the greatest possible flow and the rapid sharing of knowledge concerning those developments and the sharing of benefits, with particular attention to the needs of developing countries;

(g) to safeguard and promote the interests of the present and future generations;

(h) to underline the importance of biodiversity and its conservation as a common concern of humankind.

Principles

Within the scope of this Declaration, in decisions or practices taken or carried out by those to whom it is addressed, the following principles are to be respected.

Article 3 – Human dignity and human rights

1. Human dignity, human rights and fundamental freedoms are to be fully respected.

2. The interests and welfare of the individual should have priority over the sole interest of science or society.

Article 4 – Benefit and harm

In applying and advancing scientific knowledge, medical practice and associated technologies, direct and indirect benefits to patients, research participants and other affected individuals should be maximized and any possible harm to such individuals should be minimized.

Article 5 – Autonomy and individual responsibility

The autonomy of persons to make decisions, while taking responsibility for those decisions and respecting the autonomy of others, is to be respected. For persons who are not capable of exercising autonomy, special measures are to be taken to protect their rights and interests.

Article 6 – Consent

1. Any preventive, diagnostic and therapeutic medical intervention is only to be carried out with the prior, free and informed consent of the person concerned, based on adequate information. The consent should, where appropriate, be express and may be withdrawn by the person concerned at any time and for any reason without disadvantage or prejudice.

2. Scientific research should only be carried out with the prior, free, express and informed consent of the person concerned. The information should be adequate, provided in a comprehensible form and should include modalities for withdrawal of consent. Consent may be withdrawn by the person concerned at any time and for any reason without any disadvantage or prejudice. Exceptions to this principle should be made only in accordance with ethical and legal standards adopted by States, consistent with the principles and provisions set out in this Declaration, in particular in Article 27, and international human rights law.

3. In appropriate cases of research carried out on a group of persons or a community, additional agreement of the legal representatives of the group or community concerned may be sought. In no case should a collective community agreement or the consent of a community leader or other authority substitute for an individual’s informed consent.

Article 7 – Persons without the capacity to consent

In accordance with domestic law, special protection is to be given to persons who do not have the capacity to consent:

(a) authorization for research and medical practice should be obtained in accordance with the best interest of the person concerned and in accordance with domestic law. However, the person concerned should be involved to the greatest extent possible in the decision-making process of consent, as well as that of withdrawing consent;

(b) research should only be carried out for his or her direct health benefit, subject to the authorization and the protective conditions prescribed by law, and if there is no research alternative of comparable effectiveness with research participants able to consent. Research which does not have potential direct health benefit should only be undertaken by way of exception, with the utmost restraint, exposing the person only to a minimal risk and minimal burden and, if the research is expected to contribute to the health benefit of other persons in the same category, subject to the conditions prescribed by law and compatible with the protection of the individual’s human rights. Refusal of such persons to take part in research should be respected.

Article 8 – Respect for human vulnerability and personal integrity

In applying and advancing scientific knowledge, medical practice and associated technologies, human vulnerability should be taken into account. Individuals and groups of special vulnerability should be protected and the personal integrity of such individuals respected.

Article 9 – Privacy and confidentiality

The privacy of the persons concerned and the confidentiality of their personal information should be respected. To the greatest extent possible, such information should not be used or disclosed for purposes other than those for which it was collected or consented to, consistent with international law, in particular international human rights law.

Article 10 – Equality, justice and equity

The fundamental equality of all human beings in dignity and rights is to be respected so that they are treated justly and equitably.

Article 11 – Non-discrimination and non-stigmatization

No individual or group should be discriminated against or stigmatized on any grounds, in violation of human dignity, human rights and fundamental freedoms.

Article 12 – Respect for cultural diversity and pluralism

The importance of cultural diversity and pluralism should be given due regard. However, such considerations are not to be invoked to infringe upon human dignity, human rights and fundamental freedoms, nor upon the principles set out in this Declaration, nor to limit their scope.

Article 13 – Solidarity and cooperation

Solidarity among human beings and international cooperation towards that end are to be encouraged.

Article 14 – Social responsibility and health

1. The promotion of health and social development for their people is a central purpose of governments that all sectors of society share.

2. Taking into account that the enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition, progress in science and technology should advance:

(a) access to quality health care and essential medicines, especially for the health of women and children, because health is essential to life itself and must be considered to be a social and human good;

(b) access to adequate nutrition and water;

(c) improvement of living conditions and the environment;

(d) elimination of the marginalization and the exclusion of persons on the basis of any grounds;

(e) reduction of poverty and illiteracy.

Article 15 – Sharing of benefits

1. Benefits resulting from any scientific research and its applications should be shared with society as a whole and within the international community, in particular with developing countries. In giving effect to this principle, benefits may take any of the following forms:

(a) special and sustainable assistance to, and acknowledgement of, the persons and groups that have taken part in the research;

(b) access to quality health care;

(c) provision of new diagnostic and therapeutic modalities or products stemming from research;

(d) support for health services;

(e) access to scientific and technological knowledge;

(f) capacity-building facilities for research purposes;

(g) other forms of benefit consistent with the principles set out in this Declaration.

2. Benefits should not constitute improper inducements to participate in research.

Article 16 – Protecting future generations

The impact of life sciences on future generations, including on their genetic constitution, should be given due regard.

Article 17 – Protection of the environment, the biosphere and biodiversity

Due regard is to be given to the interconnection between human beings and other forms of life, to the importance of appropriate access and utilization of biological and genetic resources, to respect for traditional knowledge and to the role of human beings in the protection of the environment, the biosphere and biodiversity.

Application of the principles

Article 18 – Decision-making and addressing bioethical issues

1. Professionalism, honesty, integrity and transparency in decision-making should be promoted, in particular declarations of all conflicts of interest and appropriate sharing of knowledge. Every endeavour should be made to use the best available scientific knowledge and methodology in addressing and periodically reviewing bioethical issues.

2. Persons and professionals concerned and society as a whole should be engaged in dialogue on a regular basis.

3. Opportunities for informed pluralistic public debate, seeking the expression of all relevant opinions, should be promoted.

Article 19 – Ethics committees

Independent, multidisciplinary and pluralist ethics committees should be established, promoted and supported at the appropriate level in order to:

(a) assess the relevant ethical, legal, scientific and social issues related to research projects involving human beings;

(b) provide advice on ethical problems in clinical settings;

(c) assess scientific and technological developments, formulate recommendations and contribute to the preparation of guidelines on issues within the scope of this Declaration;

(d) foster debate, education and public awareness of, and engagement in, bioethics.

Article 20 – Risk assessment and management

Appropriate assessment and adequate management of risk related to medicine, life sciences and associated technologies should be promoted.

Article 21 – Transnational practices

1. States, public and private institutions, and professionals associated with transnational activities should endeavour to ensure that any activity within the scope of this Declaration, undertaken, funded or otherwise pursued in whole or in part in different States, is consistent with the principles set out in this Declaration.

2. When research is undertaken or otherwise pursued in one or more States (the host State(s)) and funded by a source in another State, such research should be the object of an appropriate level of ethical review in the host State(s) and the State in which the funder is located. This review should be based on ethical and legal standards that are consistent with the principles set out in this Declaration.

3. Transnational health research should be responsive to the needs of host countries, and the importance of research contributing to the alleviation of urgent global health problems should be recognized.

4. When negotiating a research agreement, terms for collaboration and agreement on the benefits of research should be established with equal participation by those party to the negotiation.

5. States should take appropriate measures, both at the national and international levels, to combat bioterrorism and illicit traffic in organs, tissues, samples, genetic resources and genetic-related materials.

Promotion of the Declaration

Article 22 – Role of States

1. States should take all appropriate measures, whether of a legislative, administrative or other character, to give effect to the principles set out in this Declaration in accordance with international human rights law. Such measures should be supported by action in the spheres of education, training and public information.

2. States should encourage the establishment of independent, multidisciplinary and pluralist ethics committees, as set out in Article 19.

Article 23 – Bioethics education, training and information

1. In order to promote the principles set out in this Declaration and to achieve a better understanding of the ethical implications of scientific and technological developments, in particular for young people, States should endeavour to foster bioethics education and training at all levels as well as to encourage information and knowledge dissemination programmes about bioethics.

2. States should encourage the participation of international and regional intergovernmental organizations and international, regional and national non governmental organizations in this endeavour.

Article 24 – International cooperation

1. States should foster international dissemination of scientific information and encourage the free flow and sharing of scientific and technological knowledge.

2. Within the framework of international cooperation, States should promote cultural and scientific cooperation and enter into bilateral and multilateral agreements enabling developing countries to build up their capacity to participate in generating and sharing scientific knowledge, the related know-how and the benefits thereof.

3. States should respect and promote solidarity between and among States, as well as individuals, families, groups and communities, with special regard for those rendered vulnerable by disease or disability or other personal, societal or environmental conditions and those with the most limited resources.

Article 25 – Follow-up action by UNESCO

1. UNESCO shall promote and disseminate the principles set out in this Declaration. In doing so, UNESCO should seek the help and assistance of the Intergovernmental Bioethics Committee (IGBC) and the International Bioethics Committee (IBC).

2. UNESCO shall reaffirm its commitment to dealing with bioethics and to promoting collaboration between IGBC and IBC.

Final provisions

Article 26 – Interrelation and complementarity of the principles

This Declaration is to be understood as a whole and the principles are to be understood as complementary and interrelated. Each principle is to be considered in the context of the other principles, as appropriate and relevant in the circumstances.

Article 27 – Limitations on the application of the principles

If the application of the principles of this Declaration is to be limited, it should be by law, including laws in the interests of public safety, for the investigation, detection and prosecution of criminal offences, for the protection of public health or for the protection of the rights and freedoms of others. Any such law needs to be consistent with international human rights law.

Article 28 – Denial of acts contrary to human rights, fundamental freedoms and human dignity

Nothing in this Declaration may be interpreted as implying for any State, group or person any claim to engage in any activity or to perform any act contrary to human rights, fundamental freedoms and human dignity.

The Ten Principles of the Nuremberg Code

On August 19, 1947, the judges of the American military tribunal, before rendering verdict in the Doctors’ Trial USA vs. Karl Brandt et al., presented ten basic principles for human experimentation ‘in order to satisfy moral, ethical and legal concepts’ under a section entitled Permissible Medical Experiments.  They became known as the Nuremberg Code.

1. The voluntary consent of the human subject is absolutely essential. This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision. This latter element requires that before the acceptance of an affirmative decision by the experimental subject there should be made known to him the nature, duration, and purpose of the experiment; the method and means by which it is to be conducted; all inconveniences and hazards reasonable to be expected; and the effects upon his health or person which may possibly come from his participation in the experiment. The duty and responsibility for ascertaining the quality of the consent rests upon each individual who initiates, directs or engages in the experiment. It is a personal duty and responsibility which may not be delegated to another with impunity.

2. The experiment should be such as to yield fruitful results for the good of society, unprocurable by other methods or means of study, and not random and unnecessary in nature.

3. The experiment should be so designed and based on the results of animal experimentation and a knowledge of the natural history of the disease or other problem under study that the anticipated results will justify the performance of the experiment.

4. The experiment should be so conducted as to avoid all unnecessary physical and mental suffering and injury.

5. No experiment should be conducted where there is an a priori reason to believe that death or disabling injury will occur; except, perhaps, in those experiments where the experimental physicians also serve as subjects.

6. The degree of risk to be taken should never exceed that determined by the humanitarian importance of the problem to be solved by the experiment.

7. Proper preparations should be made and adequate facilities provided to protect the experimental subject against even remote possibilities of injury, disability, or death.

8. The experiment should be conducted only by scientifically qualified persons. The highest degree of skill and care should be required through all stages of the experiment of those who conduct or engage in the experiment.

9. During the course of the experiment the human subject should be at liberty to bring the experiment to an end if he has reached the physical or mental state where continuation of the experiment seems to him to be impossible.

10. During the course of the experiment the scientist in charge must be prepared to terminate the experiment at any stage, if he has probable cause to believe, in the exercise of the good faith, superior skill and careful judgment required of him that a continuation of the experiment is likely to result in injury, disability, or death to the experimental subject.
